Introduction
India generates approximately 1.7 lakh tonnes per day (TPD) of municipal solid waste, according to the Central Pollution Control Board (CPCB). The Solid Waste Management (SWM) Rules, 2016 marked a paradigm shift in urban environmental governance by transitioning municipal waste management from unscientific disposal and open dumping toward decentralized source segregation and circular resource recovery.
Key Provisions and Waste Segregation Mandates
The SWM Rules, 2016 substantially updated the regulatory framework to fix accountability at the generator level and broaden municipal jurisdiction.
- Extended Territorial Jurisdiction: The rules expanded the application of waste norms beyond statutory urban municipal limits to include census towns, notified industrial townships, special economic zones, pilgrimage centers, and defence establishments.
- Mandatory Three-Stream Segregation: Waste generators are legally required to segregate waste at source into three distinct streams: wet (biodegradable waste), dry (recyclable items such as plastics, paper, and glass), and domestic hazardous waste (such as discarded medicine, paints, CFLs, and sanitary items).
- Bulk Waste Generator (BWG) Accountability: Entities generating more than 100 kg of waste per day or occupying more than 5,000 sq. meters must manage and process organic waste on-site using biomethanation or composting, minimizing the load on municipal landfills.
- Inclusion of the Informal Sector: Urban Local Bodies (ULBs) are mandated to formally recognize and integrate informal waste pickers and kabadiwalas into the primary collection and sorting network, enhancing livelihood security while improving collection efficiency.
Adoption of a Circular Economy Model in Urban Local Bodies
The SWM Rules, 2016 reorient Urban Local Bodies from service providers focused on transport-and-dump practices to managers of circular material loops.
- Material Recovery Facilities (MRFs): ULBs must set up dedicated sorting infrastructure where collected dry waste is segregated by polymer type and quality, feeding clean secondary raw materials directly into industrial recycling value chains.
- Wet Waste Valorization via Biomethanation: Municipal organic waste is processed into bio-CNG and nutrient-rich organic compost. For instance, Indore's 550-TPD Gobar-Dhan Bio-CNG plant converts municipal wet waste into clean vehicle fuel used to run the city's public transport fleet.
- Waste-to-Energy and Refuse-Derived Fuel (RDF): The rules mandate industrial users, notably cement manufacturing plants located within 100 km of a solid waste facility, to co-process non-recyclable high-calorific waste as alternative fuel, reducing reliance on virgin fossil fuels.
- Extended Producer Responsibility (EPR): Brand owners and packaging manufacturers are bound by EPR obligations to establish buy-back systems and finance the collection and processing of post-consumer packaging, closing the lifecycle loop.
- Legacy Waste Remediation: ULBs are instructed to remediate legacy dump sites through biomining and bioremediation, recovering soil enrichers and combustible fractions while unlocking valuable urban land.
