Terms of Use

1. Introduction

Welcome to Dalvoy. These Terms of Use ("Terms") govern your access to and use of the Dalvoy mobile application, website, and related AI-powered educational services (collectively, the "Service"). The Service is operated by Dalvoy ("we," "us," or "our"), a company incorporated under the laws of India, with its registered office in New Delhi. By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not access or use the Service.

2. Eligibility & Age Restrictions

• Minimum Age: You must be at least 13 years of age to use the Service.
• Minors (Under 18): If you are under the age of 18, you represent that you have obtained the consent of your parent or legal guardian to use the Service. Parents or guardians are responsible for the acts of minors under their care.
• Prohibited Users: You may not use the Service if you have previously been suspended or removed from Dalvoy.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information.
• Maintain the confidentiality of your account credentials.
• Notify us immediately of any unauthorized use of your account.
• Accept responsibility for all activities that occur under your account.

4. Subscription & Payments

• Dalvoy operates on a premium subscription model to provide unrestricted access to its educational features.
• Subscriptions, Trials & Auto-Renewal: By registering for any premium subscription plan or paid promotional trial, you explicitly authorize Dalvoy (or our third-party payment processor) to automatically transition your account to the applicable recurring subscription upon trial expiration. You consent to be charged the clearly disclosed recurring subscription fee to your designated payment method using the UPI mandate authenticated by you at checkout on an ongoing basis until the mandate is explicitly canceled.
• Notification Delivery Disclaimer: Dalvoy dispatches automated renewal notifications at least 24 hours prior to recurring deductions. Failure to receive or view this notification due to individual device configurations, network carrier failures, Do-Not-Disturb (DND) profiles, spam filters, or third-party banking delays does not invalidate, cancel, or excuse an otherwise authorized UPI mandate renewal.
• Except as expressly provided in our Refund Policy or where strictly required under applicable Indian law, all subscription fees paid to Dalvoy are non-refundable. We do not provide refunds or credits for partially used subscription periods, nor for failure to cancel the mandate prior to renewal.
• Account Sharing: Subscriptions are for individual use only. Concurrent logins across multiple devices or sharing account credentials will result in immediate account termination without a refund.
• Dalvoy reserves the right to adjust pricing for premium services, with changes taking effect following notice on the Pricing Page or upon your next renewal.

• About Us: Dalvoy is an independent exam preparation app. Dalvoy is not an official government application and is not affiliated with, endorsed by, or associated with UPSC, or any government body or examination authority in any form. All official exam-related information is sourced from official websites: https://www.upsc.gov.in, https://www.pib.gov.in, https://www.india.gov.in.
• Accuracy: The Service utilizes artificial intelligence (AI) to generate content ("Output"). AI models are prone to errors and "hallucinations." Output may be inaccurate, incomplete, or misleading. You should not rely on the Output as your sole source of truth or factual information.
• No Professional Advice: Dalvoy is a study aid, not a substitute for professional human instruction, legal, medical, or financial advice.
• User Responsibility: You are solely responsible for verifying the accuracy of any Output before using it for exams, assignments, or critical decision-making. Dalvoy assumes no liability for grades, exam results, or academic outcomes resulting from your use of the Service.

6. Academic Integrity & Acceptable Use

Dalvoy is designed to assist learning, not to facilitate academic dishonesty. By using the Service, you agree NOT to:

• Use the Service to generate answers for graded exams, quizzes, or tests where AI assistance is prohibited.
• Plagiarize Output or present AI-generated content as your own original work in violation of your school or institution's policies.
• Use the Service for any illegal, unauthorized, or abusive purpose.
• Attempt to reverse engineer, decompile, or extract the source code or underlying models of the Service.
• Use the Service to generate content that is hateful, harassing, violent, or sexually explicit.

7. Intellectual Property

• Our IP: The Service, including its original content, features, designs, logos, and software, is the exclusive property of Dalvoy and its licensors.
• Your License: We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial educational purposes.

8. User Content & Data Usage

• Ownership: You retain ownership of any content you submit, upload, or display ("User Content").
• License to Us: By submitting User Content, you grant Dalvoy a worldwide, non-exclusive, royalty-free license to use, display, and reproduce such content solely for the purpose of operating, providing, and improving the Service.
• AI Training: You acknowledge that anonymized User Content may be used to improve the accuracy and performance of our AI models.

9. Service Modifications & Availability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We reserve the right to:

• Modify, suspend, or discontinue the Service at any time without notice.
• Limit certain features or restrict access to parts of the Service.
• We do not guarantee that the Service will be uninterrupted, secure, or free from errors or viruses.

10. Limitation of Liability

To the fullest extent permitted by law, Dalvoy and its directors, employees, and affiliates shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, data, use, or goodwill.
• Damages resulting from your access to or use of (or inability to access or use) the Service.
• Damages resulting from any conduct or content of any third party on the Service. In no event shall Dalvoy's total liability exceed the amount you paid to Dalvoy in the past six (6) months, or ₹1,000 INR, whichever is lower.

11. Indemnification

You agree to defend, indemnify, and hold harmless Dalvoy and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party right or academic policy.

12. Governing Law & Dispute Resolution

• Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of India.
• Dispute Resolution: Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, such invalidity shall not affect the remaining provisions of these Terms, which shall remain in full force and effect.

14. Changes to These Terms

We may update these Terms from time to time. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the terms.
