Explanation

The Constitution of India initially prescribed the composition of the Supreme Court, but it also provided a mechanism for its alteration. Article 124(1) states: "There shall be a Supreme Court of India consisting of a Chief Justice of India and, until Parliament by law prescribes a larger number, of not more than seven other Judges." This constitutional provision clearly vests the power to increase the number of judges in the Supreme Court of India with the Parliament. Parliament exercises this power through ordinary legislation. For example, the number of Supreme Court judges has been increased several times by parliamentary laws, from the initial 8 to the current strength.
